RTPR has obtained a final decision reducing a fine imposed by Romania’s Competition Council on Zenith by over 85%.
Zenith is the Romanian subsidiary of Publicis Groupe. Publicis Groupe is an international group based in Paris.
According to RTPR, the matter involved two procedural cycles, complex financial and technical assessments, and a preliminary reference to the CJEU, which ultimately led to a binding interpretation of EU law in Zenith's favor. "This precedent-setting decision has clarified how fines for competition law infringements must be calculated, especially for companies whose formal turnover does not reflect their actual income due to the nature of their business."
