Musat & Asociatii has successfully represented MMT121 Gaming before the High Court of Cassation and Justice, clarifying the tax regime applicable to gambling operating licenses in Romania following recent legislative changes.
According to Musat & Asociatii, the dispute concerned the annulment of a decision issued by the National Gambling Office, which required MMT121 Gaming to pay the full annual license fee despite limitations imposed on its activity as a result of amendments to Government Emergency Ordinance No. 77/2009 on the organization and operation of gambling. In its ruling, the High Court confirmed an interpretation favorable to economic operators, holding that the annual tax regime must be assessed in light of restrictions on licensed activity introduced by legislative amendments.
